LEGAL NOTICE OF
SCENIC ROAD AND SHADE TREE
JOINT PUBLIC HEARING
 
In accordance with Massachusetts General Laws (MGL), Chapter 87, Public Shade Tree Law, Section 3 (Cutting of Public Shade Trees; Hearing; Damages) and M.G.L. Chapter 40, Section 15c (Scenic Road) and Section 250-24 of the Bolton Zoning Bylaws (Scenic Roads), the Town of Bolton Tree Warden and Planning Board will hold a Joint Public Hearing on Wednesday, April 14, 2021 at 8:30 P.M. via Zoom Video Communications, Inc. (Zoom) regarding an application from Bolton’s Department of Public Works to remove seven (7) public shade trees from Spectacle Hill Road. These trees are located in the vicinity of #5 and #12 Spectacle Hill Road on both sides of the road to facilitate a drainage improvement project.  The trees are identified as follows:
 
Abutting 5 Spectacle Hill Road:
One (1) 34” dia. Oak, One (1) 35” dia. White Pine, and One (1) 34” dia. White Pine.
 
Abutting 12 Spectacle Hill Road:
One (1) 18” dia. & 17” dia. multi-leader Oak, One (1) 34” dia. White Pine, One (1) 28” dia. Oak, and One (1) 32”dia. Pine.

Acts of 1908, Chapter 296
Section 3, Public Shade Trees shall not be cut or removed, in whole or in part, except by the Tree Warden or his deputy, or by a person holding a license to do so from the Tree Warden, nor shall they be removed by the Tree Warden or his deputy or other person without a public hearing at a suitable time and place, after notice posted thereof in two or more public places in town and upon the tree, and after authority granted by the Tree Warden thereof. Whoever violates the provisions of this section shall forfeit not less than five nor more than one hundred dollars to the use of the Town.
