Prior to 1972, the Town of Bolton had open zoning. The Smith Property operated as a gas station since the 1920's. In 1972 the Town adopted zoning districts and created the business and industrial zones. All existing businesses not located in a business or industrial district are classified as a Pre Existing Non Conforming Use/Structure. State Law states that if the use is abandoned for a period of two years the use must conform with zoning. Current zoning is residential. In order for the Smith property to be developed other than residential use would require a zoning
change. There have been numerous commercial proposals. Currently, Partners for Planning (group of Bolton residents) are negotiating with the owners on terms and have brought an article to a fall Special Town Meeting, which failed the 2/3rds vote required.
